After a trial where complex and competing evidence was given by two veterinary surgeons and one police expert the defendant was acquitted and his dogs released
Miss S – pleaded guilty to an offence under s3 of the Dangerous Dogs Act and a further offence of breaching a control order imposed in respect of her bull mastiff dog.   View details Hide details
Her dogs had escaped from the house without a muzzle or lead and had then attacked another dog and bitten two people who tried to break up the fight. Miss S was fined and her dog returned to her with conditions regarding it’s future control.
Mr A – was found not guilty of being the owner of a dog that was dangerously out of control and caused injury   View details Hide details
. It was alleged that his dog had jumped up at a child and then bitten her as she tried to run away. The court found that she had not been bitten and that her apprehension of being injured was not reasonable

The police opposed the dog being returned to her but the magistrates were persuaded that the dog posed no risk to the public and ordered it to be returned to her with conditions for it’s future control.
